Businesses using North Northamptonshire’s household recycling centres as a shortcut for commercial waste risk enforcement action. A four-month council campaign produced 71 formal actions: 55 warning notices and 16 Fixed Penalty Notices.

The offences included littering, fly-tipping and breaches of waste Duty of Care requirements. Six of the 55 warnings were issued to members of the public for abusive behaviour towards recycling-centre staff.

Commercial waste rules cover businesses of every size

Waste produced through commercial activity cannot be treated as ordinary household rubbish. The rules apply to sole traders, landlords, home-based businesses, small and medium-sized firms and large industrial operations.

This means that waste from jobs carried out at customers’ homes, rental properties or a business run from a residential address remains commercial waste. The size of the operation does not remove its legal responsibilities.

Records must be retained for at least two years

Under the Environmental Protection Act 1990, businesses must ensure their waste is stored, transferred and disposed of correctly. They must use registered waste carriers and maintain Waste Transfer Notes for a minimum of two years.

Council officers can ask to inspect those records at any time. A business therefore needs to know who collected its waste, where it went and whether the carrier was properly registered.

How to dispose of trade waste correctly

Household Waste Recycling Centres in North Northamptonshire are intended for household rubbish. Businesses should not take commercial waste through the normal household disposal route.

To remain compliant, a business should:

Separate commercial waste from personal household rubbish.
Arrange collection or disposal through a registered waste carrier.
Obtain and retain the relevant Waste Transfer Notes for at least two years.
Keep the records accessible in case council staff request an inspection.

Kettering and Rushden are the only centres in the area offering a dedicated paid-for trade waste service. It is operated separately by H M Martin Waste Ltd and is available to businesses holding a valid Waste Carrier Licence. Waste is weighed and processed through the sites’ weighbridge facilities before disposal.

Warnings can escalate to financial penalties

The four-month campaign shows that officers are checking both disposal practices and supporting records. The source notice does not state the value of the 16 Fixed Penalty Notices, but confirms that penalties were issued alongside formal warnings.
