A Hornchurch resident has been fined a total of £2,191 after dumped waste bags in Allendale Road were traced back by Havering Council’s environmental enforcement team.

Council officers acted after a report of fly-tipped bags in the street. They said information found inside the waste linked it to the address of Jelena Jermakovica, from Hornchurch.

£2,191 penalty at Barkingside Magistrates Court

Jermakovica was prosecuted at Barkingside Magistrates Court after, according to the council, she ignored Fixed Penalty Notices, a statutory notice under section 108 of the Environment Act 1995, and several requests to assist with the investigation.

The case was heard in her absence after she failed to attend court. She was fined £440 and ordered to pay a £176 victim surcharge and £1,575 in costs, bringing the total to £2,191.

Havering Council said its officers followed up the report of dumped waste in Allendale Road and examined the bags for evidence. Information found in the rubbish was then used to trace the waste back to Jermakovica’s address.

The council said the case showed that dumped household waste can still lead to prosecution when evidence links it to a person or property.

Havering clean-up costs put at about £1 million

Helen Oakerbee, Havering’s Director of Planning and Public Protection, said the council would take action against those responsible for illegal dumping.

“We won’t tolerate the illegal dumping of waste in our borough and as this example shows, we will take the necessary action against those who think they can get away with it,” she said.

Oakerbee said fly-tipping affects residents, businesses and the local environment, with clean-up costs of around £1 million a year falling on council taxpayers.

The council said residents should dispose of rubbish legally, check that any waste carrier they use is properly licensed, and continue reporting fly-tipping in the borough.
